Your Rights and Protections Against Surprise Medical Bills
When you receive emergency care or are treated by an out-of-network provider at an in-network facility, you are protected from unexpected medical bills under the federal No Surprises Act.
This means you should not receive surprise billing for certain covered services.
What Is “Balance Billing”?
When you see a healthcare provider, you may owe certain out-of-pocket costs such as copayments, coinsurance, or deductibles.
If you receive care from a provider or facility that is not in your health plan’s network, they may bill you for the difference between what your plan pays and the full amount charged. This is called balance billing.
The No Surprises Act limits when patients can be balance billed.
Your Protections
You are protected from balance billing for:
• Emergency services
• Services provided by out-of-network providers at an in-network facility
In these situations:
• You are only responsible for your in-network cost-sharing amount
• Your provider cannot bill you for more than that amount
• Your cost-sharing counts toward your in-network deductible and out-of-pocket maximum
When Balance Billing Is Not Allowed
Providers cannot balance bill you for:
• Emergency services
• Certain services provided at in-network facilities
This includes situations where you may not have control over who provides your care.
Notice and Consent
In certain non-emergency situations, you may be asked to consent to out-of-network services.
If you choose to receive care from an out-of-network provider when alternatives are available, you may be asked to sign a consent form acknowledging potential additional costs.
You are never required to waive your protections.
Good Faith Estimate
If you do not have insurance or choose not to use your insurance, you have the right to receive a Good Faith Estimate of expected charges before receiving services.
This estimate helps you understand the anticipated costs of your care.
